Some people argue that smoking is permissible. Some other scholars argue that smoking is illegitimate, this opinion is affirmed by Qalyubi (Shafi’i Ulama, died: 1069 H). In the book of Hasyiyah Qalyubi in the style of Syarh al-Mahalli (volume I, p. 69), he said that: “Cannabis and all drugs that eliminate reason, even sacred substances are haram for consumption, therefore our scholars argue that legal cigarettes are also haram, because cigarettes can open the way for the body to contract various dangerous diseases”.

Ibn Allan (scholar of Syafi’i Madhab, died: 1057H), as-Sanhury (Mufti of the Maliki School in Egypt, died 1015 H), al-Buhuty (Hanbali Ulama, died: 1051 H), as-Surunbulaly (Hanafi School of Ulama, died: 1069 H) also said that it was illegal to smoke.  Smoking was also banned by Ottoman rulers in the 12th century Hijriyah and people who smoked were subject to sanctions, and the cigarettes circulating were confiscated by the government, then destroyed.

The scholars emphasized the prohibition of smoking based on the agreement of doctors at that time, which stated that smoking was very dangerous to the health of the body. It can damage the heart, the cause of chronic cough, narrows the blood flow which causes bloodlessness and ends with sudden death.

The results of medical research in the present era reinforce the discovery of medicine in the past that smoking causes various types of cancer, respiratory diseases, heart disease, digestive diseases, bad effects on the fetus, also damages the reproductive system, in short, smoking damages the entire body system. Therefore, all countries set laws that require the imposition of warnings that smoking can harm the health of the body in each pack of cigarettes.

It is very appropriate that fatwas issued by various fatwa institutions in the Islamic world, such as the MUI fatwa forbidding cigarettes, as well as the Saudi Fatwa Council forbidding smoking, through fatwa number: (4947), which states, “Smoking is illegal, planting raw materials (tobacco) are also haram and trading is also haram, because cigarettes cause such a great danger .

Therefore, scientists and the scholars forbid smoking. That is because there is a great danger in it, which smokers know for themselves. And known by health experts and also known by everyone who associates with smokers.

Sometimes, the cigarette also causes sudden death and other diseases, causes coughing, causes permanent disease, we all know it all. And we all know a lot of news about this fact about smokers or sisha suckers and the types of cigarettes that are for example. Everything is dangerous, it is obligatory to prohibit it and is obligatory for health experts to advise smokers, and it is also mandatory for doctors and teachers to leave cigarettes because doctors and teachers are usually emulated.

Cigarettes are clearly a danger and sin is greater than the benefits that are not yet clear so that it includes things that are forbidden by Allah. Indeed the benefits of cigarettes are only claims and defenses from mere smokers without the support of arguments and evidence.

“In the rules of fiqh, it is stated “Preventing danger is better than treated”.
